Call for Tenders and Invitation to submit Tenders

HjulmandKaptain assists both public authorities and private companies to a great extent in connection with the completion of open tendering, EU tenders or similar administrative issues. Our counselling comprises general guidance on procurement rules and specific guidance in relation to the completion / submission of EU tenders and/or national calls for tenders.

Private companies

HjulmandKaptain assists private companies with general counselling in the handling of tender procedures, EU tenders and national calls for tenders under the Danish Act on Tender Procedures, e.g. in relation to companies’ submission of tenders.

Among other things, our counselling comprises the following elements:

• Legal counselling on tenders under the public procurement rules, including the Public Procurement Directive (EU law), and the Danish Act on Tender Procedures;
• education in the Public Procurement Directive (EU law), and the Danish Act on Tender Procedures;
• counselling and guidance in connection with the submission of tenders;
• assistance in connection with the notification of awards of contract;
• drafting of requests for justification for refusals of tenders, if any;
• assessment and guidance on the submission of complaints, if any, with the Complaints Board for Public Procurement;
• invitation of tenders and contracting.

Invitation of tenders and contracts

HjulmandKaptain assists both public authorities and private publicly subsidized or publicly governed foundations/bodies with qualification of building projects and public works contracts, purchase and sale of municipal premises, purchase and conclusion of agreements on services etc., on interfaces and scope of procurement rules and consequential possibilities and consequences for the authorities or foundations/bodies concerned. Our assistance comprises both procurement rules for EU tenders and national tenders under the Danish Act on Tender Procedures.

In this connection, HjulmandKaptain advises on the obligation to invite tenders, if any; and where relevant, we offer thorough integral counselling on the completion of tender processes, including the choice of procurement methods.

In connection with calls for tenders and procuring of tenders for building projects and public works contracts, HjulmandKaptain assists public building owners and/or advisers thereof with counselling on all tender elements and the interaction with rules and interests pertaining to construction law, including the special rules for assessment of non-profit and/or subsidized building projects and the importance thereof for the completion of tenders and formation of contracts.

In addition to calls for tender concerning specific building projects or public works contracts, HjulmandKaptain also advises on the formation of contracts as to the supply of related consultancy services or in other respects, including project works, construction supervision and/or subsequent building owner consulting.

Our counselling within this area is performed in close interaction with the counselling on subjects pertaining to construction law, where HjulmandKaptain advises on the drafting of construction contracts, consultancy agreements, handling of various issues during the completion of building works and any subsequent conflict management.

Exchange and sharing of knowledge

HjulmandKaptain currently convenes meetings with the participation of representatives for public authorities and private companies about predetermined subjects relating to the development within procurement rules and/or the practice of the Complaint Board for Public Procurement and/or the courts of law.

In addition, HjulmandKaptain organizes internal courses upon agreement with public authorities and/or private companies about procurement rules and/or practice announced by the Complaint Board for Public Procurement and/or the courts of law, e.g. with special focus on other legal areas of specialization, such as construction law, municipal law, environmental law, regulation of purchase and sale of real estate, publicly subsidized building projects, etc. Such interaction may take place by virtue of our internal network of special competences, both internally at HjulmandKaptain and externally in relation to our cooperation partners.

At such courses, the content is coordinated with the participants – the public authority and/or the company - based on existing specific requirements and news within the specific area.
